The State Of The Ordinance

“With liberty and justice for all,” the people said, with their hands upon their hearts.  They shuffled as they took their seats or remained standing in the crowded council chambers at city hall in Helena.  I wondered how many in attendance actually believed in those concepts they had just pledged their allegiance to.  Many seemed to believe that liberty and justice should be applied only to those they alone deemed worthy.

The opponents had arrived early and assured that their ranks would take all the seats, leaving standing room only for the gays and lesbians, the Bi-s and transgender, and all their allies (friends, family and supporters).  Though seemingly greater in number they were mostly relegated to the hallway outside the chambers, or an overflow room set up for viewing the proceedings on a large screen.  It was filled to overflowing as well.

I had arrived early enough to take one of the last places for standing inside the chambers – in the aisle next to the last row of high-backed seats.  I thought of the pews in the Catholic church of my youth as I stood firmly, almost defiantly, and prayed for grace and tolerance.  Though transgender, I remain just old fashioned enough to have wondered if any of the good seated gentlemen would offer me their seat.  None did.

At that very moment I wondered if I had not begun to understand just a glimpse of what Rosa Parks felt as she resolved to take her seat at the front of the bus.  While the opponents wore stickers which implied that LGBT rights are “special rights,” they graphically displayed exactly why they are necessary.  The inequality of the seating arrangement was readily apparent and not lost on many of those standing outside, craning their necks to hear and see the proceedings inside.  Were they not marginalized by the very people who proclaim it is not so?

As the council progressed through its agenda the tension mounted to a palpable level no matter which side of the LGBT rights issue you stood on.  It could be felt collectively.  The mayor came to the matter he correctly surmised we had all come to hear.  The council made and discussed amendments to the pending LGBT anti-discrimination ordinance that proposed to protect LGBT people from discrimination in housing, employment and public accommodation.

The first was the “locker room” amendment proposed with ambivalence and stated with reluctance by one commissioner due to an email he received about a pre-op transwoman in Evergreen, CO who had apparently, yet inadvertently, dropped the towel which covered her genital area while in the sauna, offending another woman.  The amendment would not extend protections to such transwomen in bathrooms, locker rooms or public facilities in which people customarily are nude.

The second amendment was of greater consequence, though not immediately apparent.  It provided that persons who felt they were discriminated against due to their LGBT status would have to first file their claim with the state Human Rights Bureau, and could only file with the city if the state rejected their claim.

Both amendments were adopted, and now came the time for public comment.  As a proponent, I got to speak first.  Here is some of what I said:

I am a civil rights attorney here in Helena.  I am also Transgender, as many of you know. I am anatomically consistent with my appearance in all respects for whatever that is worth to others – I know and am very grateful for what it is worth to me.

I support the ordinance without the “swimming pool”amendment because I have experienced discrimination here in Helena on more than one occasion, although never in the locker room, or bathroom, or anywhere else of that nature – even during the year prior to surgery when I presented full time as a woman, though anatomically still male.

The irony of the position that I find myself in is not lost on me.  Other than undergoing a procedure to correct something that was wrong my entire life,- a procedure that some think is a bit radical, I am a pretty conservative woman – in presentation, dress, style and activities.  I go to church, work here in Helena, shop here, and pay taxes.  I do not drink, smoke or gamble and don’t go with the boys who do.  In fact, I don’t go with boys, but that is another matter.

I am also rather modest & find it difficult in public to talk about, of all places, the bath room, and I wonder what kind of mind conceives of the threat a person such as myself presents in the rest room.  What kind of mind conceives of prurient activities in bath room stalls?  The thought repulses me.  Nonetheless, I can assure you that I (and others I know in this area) have only one interest in the rest room or locker room – relieving myself or changing my clothes

Now I wonder if there is anyone in this room whom I offended when I went to the woman’s rest room or locker room.  No one has ever said a single word about it, nor even cast a cross glance at me.  In fact, in the beginning, I was more afraid of everyone else than they could ever be of me.  For a trans person, the greatest single fear we live with our entire life is being found out – getting “read” in trans parlance.  That fear is so strong, that some people kill themselves or hide in a self constructed box for decades because they are afraid that if people knew they were transsexuals they would be reviled, rejected, scorned and perhaps worse.  Trans people are assaulted every day, and in some cases murdered for trying to overcome their fears and be true to themselves.  That fear is based on actual events – it is real, it is rational and it is pervasive.

On the other hand, when was the last time you saw a man expose himself in a woman’s rest room?  When was the last time you saw an anatomically incorrect person in the locker room in all their glory?  I have not had that experience in the five+ years I have lived and worked in Helena.  I wonder if the sheriff and police chief could enlighten us with the number of calls they have fielded of this nature in the last ten years?

So, I ask you.  Is the fear of males in the woman’s locker room real?  Is it rational?  The reality is that trans people are so afraid of being read, that they are not “passing” in the gender of identity, that they would not dream of exposing themselves until they are anatomically consistent, and would sooner forfeit their life than take that chance.  There may be some men who would do that, but, I assure that their issues are not gender identification dysphoria and the laws are already in place to prosecute them.

I say it again – trans people have by far more to fear from society than any part of society has to fear from them.  It is a public safety issue – and it is the trans people would need protecting.People in Helena are already using the bathrooms and locker rooms where they feel safest and most comfortable.  If a transman or transwoman were to expose him or herself for some prurient interest, the circumstances are amenable to prosecution under the criminal code.  This ordinance does not change any criminal codes (like sexual assault or indecent exposure, i.e. exposure for sexual gratification).  If a crime were to take place, it should be investigated the same way that crimes are investigated currently, and similarly prosecuted.  We can work together as a community to prevent and address crimes, make our city safer, and more just.  We can do the education necessary to make sure that all members of our community feel safe and are able to fully participate. This ordinance is one step in making our community safer and stronger, and reflecting our values of liberty and justice for all.

I believe that still.  However, the amendments now threaten to swallow the rule and dissolve any gains we might have made in the effort to end discrimination.  The “locker room” question is a tough issue, and as a former elected official, I have great empathy for the council.  No one should be forced into a position not of their own choosing where they are threatened and afraid; and this cuts both ways.  Imagine the shock a genetic woman might feel as she turns a corner, naked, only to see a pre-op transwoman in all her beautiful glory.  On the other hand, imagine the ridicule and risk to safety for a naked transman in the woman’s locker room, or the risk to safety for the transwoman, both pre and post op in the men’s locker room.  Thus, we have a dilemma.

It seems to me that when faced with such a dilemma that compromise is the only solution.  The compromise I propose is that the “locker room” amendment should be revised to preclude only those with socially inconsistent genitalia from revealing as much, from exposing such inconsistent genitalia.  To be clear, a pre-op transwoman cold be excluded from the female locker room if she exposes her penis, and similarly a transman if he reveals the lack thereof in the male locker room.  I make this suggestion knowing that many trans people will feel deprived from full participation in activities like showering at the gym, or sitting naked in the sauna in their true gender.  While true, I cannot see that it can be helped.  It is a comprise after all, and like any settlement, no one is completely happy.

The second amendment, which I refer to as the HRB amendment, is in fact of greater consequence and should be stricken.  First, the HRB operates under the auspices of the Montana Human Rights Act and the Civil Rights Act.  The MHRA affords no LGBT protection and could not be relied upon in pursuing an HRB claim.  The Civil Rights Act provides only speculative relief for the LGBT folks, and a merely persuasive argument for trans folk in employment only in accord with Macy v. Holder, an administrative law opinion rendered by the EEOC which recognized, as a number of federal courts have, a “gender stereotyping” claim under Title VII of the act as a means of sex discrimination for trans people.  Moreover, if the HRB, the defacto discrimination expert accepts an LGBT claim under Title VII, than the city claim will not be necessary.  On the other hand, if the HRB rejects a claim it will not likely be possible because good lawyers would use it as evidence in a motion to dismiss the city claim.  When the HRB says that it could not find reasonable cause to believe that discrimination occurred, it is both compelling and persuasive.  I believe it would be dispositive in this circumstance, rendering the city ordinance a nullity.  Thus, this amendment must be defeated.

If Helena, as a community can iron out these difficulties and pass this ordinance than we will take one step closer to liberty and justice for all.  And I hope that we do because Everybody Matters.

Bobbie Zenker is the author of the new book, TransMontana: a Memoir of Transformation of Body, Mind & Spirit. TransMontana is the story of Montana hunter and former county attorney Robert Zenker’s transition from a male, popularly elected official to modern, professional woman. That We May Never Forget

…that the pain, suffering, secrecy and martyrdom of the brave queer people before us are the reason that we have lives filled with less fear today.

Pioneering gay rights activist Harvey Milk (1930-1978) was assassinated on Nov. 27, 1978 (34 years ago today). Milk is the first and most famous openly gay male elected official in California, and perhaps the world. He became the public face of the LGBT rights movement, and his reputation has continued to grow since his death. He has been called a martyr for GLBT rights.

“If a bullet should enter my brain, let that bullet destroy every closet door in the country,” Milk said. Two bullets did enter his brain, and his vision of GLBT people living openly is also coming true.

Milk has received many honors for his visionary courage and commitment to equality. He is the only openly gay person in the United States to have an official state holiday in his name. Harvey Milk Day is celebrated in California on Milk’s birthday, May 22. The bill establishing Harvey Milk Day was signed in to law in fall 2009, and the holiday was celebrated for the first time this year. State employees still have to work on Harvey Milk Day, but California public schools are encouraged to teach suitable commemorative lessons about the gay rights activist.

In 2009 Milk was posthumously awarded the Presidential Medal of Freedom and inducted into the California Hall of Fame. He was included in the Time “100 Heroes and Icons of the 20th Century” for being “a symbol of what gays can accomplish and the dangers they face in doing so.”

He is the subject of two Oscar-winning movies, “Milk” (2008) and “The Times of Harvey Milk” (1984), as well as the book “The Mayor of Castro Street” by Randy Shilts.

Milk was elected to the San Francisco Board of Supervisors in 1977 after three unsuccessful efforts to run for office. He served only 11 months before he was killed, but in that short time he was responsible for passing a tough gay-rights law.

Haunted by the sense that he would be killed for political reasons, Milk recorded tapes to be played in the event of his assassination. His message, recorded nine days before his death, included this powerful statement:

“I ask for the movement to continue, for the movement to grow, because last week I got a phone call from Altoona, Pennsylvania, and my election gave somebody else, one more person, hope. And after all, that’s what this is all about. It’s not about personal gain, not about ego, not about power — it’s about giving those young people out there in the Altoona, Pennsylvanias, hope. You gotta give them hope.”

Shots fired by conservative fellow supervisor Dan White cut Milk’s life short. More than 30 years later, the hope and the movement for GLBT rights are more alive than ever.

The Harvey Milk icon painted by Robert Lentz (pictured above) was hailed as a “national gay treasure” by gay author/activist Toby Johnson. Milk holds a candle and wears an armband with a pink triangle, the Nazi symbol for gay men, expressing solidarity with all who were tortured or killed because of their sexuality.

It is one of 10 Lentz icons that sparked a major controversy in 2005. Critics accused Lentz of glorifying sin and creating propaganda for a progressive sociopolitical agenda, and he temporarily gave away the copyright for the controversial images to his distributor, Trinity Stores. All 10 are now displayed there as a collection titled “Images That Challenge.”

A Lesson In Underestimating The People In The Pews

 

A Lesson to Be Learned from Marriage Equality Victories

The news is almost too incredible to believe.

Yesterday, marriage equality was made the law of the land in three states–Maine, Maryland, and Washington State–and a proposed constitutional ban against marriage equality in a fourth state–Minnesota–was defeated.

Catholics played a significant role in all four states.  In Maine, Maryland, and Washington State, the original laws that were upheld by the referendum were all signed by Catholic governors.  In those states and Minnesota, active groups of Catholics for Marriage Equality worked tirelessly to get out the vote.

What makes the efforts of these Catholics for Marriage Equality so significant is that they have worked against incredible odds.  In each case, Catholic bishops have worked against marriage equality, and their power and influence is formidable when it comes to election campaigns.

It’s not the moral authority that the bishops have.  Indeed, due to the sexual abuse crisis among other things, their moral authority has seriously decreased in the last decade.  What they do have though is a vast communication infrastructure:  parishes, sermons, letters, mailing lists, bulletin inserts, schools–these are incredibly powerful tools to mobilize voters to vote the way the bishops instruct.  Despite these advantages, the bishop failed.

The lesson of this election for Catholics interested in LGBT equality is that lay organizing is becoming more powerful than the bishops’ organizing.  Despite that lay organizers do not have the access to Catholics that the bishops have, they have found a variety of methods to get their message across:  public vigilsYouTube videoscommunity forums, and newspaper advertisements, to name only a few.

We’ve also seen that having courageous priests and religious who are not afraid to speak out for equality are emerging.  Their witness gives us hope that others will soon step forward to urge people to form and follow their consciences with regard to marriage equality.

May the victories today inspire Catholics to continue to work for justice and equality for LGBT people.

LGBT People And Catholics Are Already Election Day Winners

Today is Election Day in the United States of America.  If you are even just an occasional reader of this blog, you will know that in three states–Maine, Maryland, Washington State–voters will be asked to decide whether or not marriage equality for lesbian and gay couples will be law.  In a fourth state, Minnesota, voters will be deciding whether to enact a constitutional amendment which would ban marriage equality for lesbian and gay couples.

In all four states, Catholics have played a key role in the campaigns to support marriage equality.  As evidence, just enter any one of the state names, in the “Category” filter in the right hand column of this page, and you will find a wealth of blog posts from the past 12 months about how Catholics have been involved in the struggle for marriage equality.

This week, the National Catholic Reporter has editorialized on the potential outcomes of today’s votes, and has declared three groups of winners of the election already, regardless of the results.   As the following quotation from the editorial will demonstrate, those “winners” include LGBT people:

“We do not yet know the fate of the ballot initiatives in the four states voting on measures related to same-sex marriage. Regardless of the outcomes, one thing is for sure: Our LGBT brothers and sisters are taking their rightful place alongside us as full citizens. It will take more time yet for legislation to fully acknowledge this, but few will dispute that this election season, a tide was turned. We don’t yet know the final result, but this community might have helped re-elect a president.

“This year, LGBT Catholics have also claimed — maybe ‘earned’ is the better word — new respect within the church. To listen to our most public leaders, this may be hard to see, but in the pews across America, it is not. Whether it is citizens signing their names to newspaper ads or brave priests risking censure from their bishops, Catholics are telling our homosexual brothers and sisters that we are glad they stand in the assembly among us. We are family. Like civil laws, it will take time for church structures to formally acknowledge this, but we believe that this year will prove an important step toward achieving equality in the Catholic church.”

(The other two groups the editorial mentions are the “Nuns on the Bus” for their work to raise awareness of economic inequality; and Latinos, for becoming a strong enough voting bloc to warrant the attention of both parties.)

We could not agree more with this editorial.  Regardless of whether or not marriage equality becomes an option in these four states,  LGBT people and the goodness of their relationships have been given a level of visibility that was unthinkable 15 years ago.  And Catholic support for LGBT people and issues has not only been increasing, but more and more leaders in government and media are becoming aware that Catholics are overwhelmingly pro-LGBT.  Because of this, Catholics, too, have already emerged as winners from the election.

While we are hopeful that equality, fairness, and justice will soon be the law of the land, we know that if today’s election results do not move that agenda along, it will only be a short wait before these values become a reality for all in the U.S.

Log Cabin Republicans “Sell Out”- Endorse Romney

Today, the Log Cabin Republicans endorsed Mitt Romney for president. National Stonewall Democrats Executive Director Jerame Davis had the following reaction:

“The Log Cabin Republicans have proven once and for all that they are not an organization aligned with the LGBT movement. They are a Republican front group bumbling their way into fooling LGBT voters that it’s OK to support a party that would legislate us back into the closet.

“Their endorsement of Mitt Romney isn’t just shameful – it’s insulting. Mitt Romney stands for nothing positive for LGBT people. He supports a federal marriage amendment (which was a reason for Log Cabin to refuse to endorse George W. Bush in 2004). He supports McCarthy-like investigations into our community for evidence of ‘harassment of Christians’. He opposes the repeal of DOMA. He opposes ENDA. He’s even said things as basic as the right to visit your sick or dying loved one in the hospital is a ‘privilege’ and not a right.

“On top of all of that, Mitt Romney is a liar. He has told so many untruths and changed his positions so many times throughout this campaign, how can Log Cabin – or anyone – trust a word he would say? A person with no moral compass goes whichever way the political winds blow. With Mitt Romney in charge of the ship of state, we would be a rudderless nation with nothing but luck to keep us from crashing into the rocky shore – and Log Cabin Republicans believes this is the best their party and our country can muster.

“It’s a disgrace. A once venerated and decent organization has become a shell of itself blithely pandering to the least common denominator. This is politics at its worst – when a community sells out its own people for the gain of a few individuals. There is little doubt that Clarke Coooper’s position on the RNC finance committee played a major role in this decision. Of course, so did their blinding fear of GOProud nipping at their heels.

“So there you have it – the Log Cabin Republicans, who screamed loudly and forcefully for months that liberal groups and LGBT movement posturing weren’t going to affect their endorsements have instead allowed the interests of money sucking GOP insiders and the fear of a conservative performance troupe to decide their endorsement for them.

“It’s reprehensible. Have they no decency?”

My take is this: For today’s Log Cabin Republicans, human rights take a back seat to economic rights might. They are willing to endorse candidates and policies that cause people like themselves greater suffering and indignity in favor of currying political clout with a party that loathes them.

It’s a real-world example of Stockholm Syndrome- where the captive becomes sympathetic to their captor, never realizing they have no freedom until they leave.

 

A Thirst For Justice

This was my reflection at the Bozeman Unitarian Universalist Fellowship this morning for their “LGBT Voices” service.

I grew up in the 70’s. A Roman Catholic. Back then, the emphasis was less on “Roman” and more on “Catholic”. Catholic as you might know means “Universal”.

My religious training as a kid was very ecumenical, non-dogmatic, fresh on the heels of Pope John’s Vatican Council- designed to open the windows and doors of the church for some fresh air- and as such, there was a heavy emphasis on social justice and the dignity of the human person. I had wonderful teachers, nuns, priests, parents, and peers- and we all believed steadfastly in this principle probably first espoused by Confucius:

“Do not impose on others what you do not wish for yourself.”

This, it seems, is one of the crowning principles of justice.

And I loved it- I still do. It guides my life even today.

But what I wished for myself was peace- and it was jeopardized, in some part, by the dogmatic underpinnings of shame in the faith that taught me those strong tenets of social justice. Something wasn’t quite right- and it took me decades to reconcile it. I was born, some have said, “disordered”. Simply because of something that flowed from the depths of my being, from my heart: I wanted to fall in love with another man.

Words like “disordered” or “unnatural” get thrown around a lot by people who really aren’t willing to try and understand. They may find it more comfortable to sit in judgment, without trying to sit in empathy or compassion. Possibly because they lack the imagination to believe that God could truly surprise the world.

But seriously, if that’s not something God would do, there’s not much point in being God, is there?

But there it is. This is who I am.

And I’m not alone. There are millions of people, like myself who are born out of the course of “normal”. For some it’s sexuality, for some it’s different senses of beauty or reason or silence or vision. It’s all the same.

I realized that sense of justice that I was born with, that sense of “Do not impose on others what you do not wish for yourself” must be followed by that which is like it “Do not take away from others what you do not wish to take away from yourself.”

LGBT persons must not be oppressed- we must be included, we must be loved- not only in spirit, but in person. For me, this is peace. This is justice.

And keeping me and my sisters and brothers and friends from achieving the same level of happiness as they enjoy is unjust. It’s unfair, and it’s spiteful.

This is the civil rights issue of our day. This is the moral rights issue of our day. And I’m not just talking about churches and theology here. As one nun I know and love reminded me recently “freedom of religion also means freedom from religion.” I don’t have the right to force my religious beliefs on anyone, but conversely, no one has the right to force theirs on me. Which seems to happen a lot sometimes- the forcing of belief on others. I have freedom of religion, so I’m going to use it, not abuse it.

My religion is based on love.

And justice.

Right now, in Montana, there is a campaign to have fairness for all couples- regardless of sexuality. It represents everything I believe: that I deserve the same protections as my parents had. It’s called the Fair is Fair Campaign– and I have enough bumper stickers for every car in the parking lot….

I left Montana for 10 years, but I promised myself when I moved back, that I would not hide who I am, that I would “suffer the slings and arrows” if it meant that a kid who grew up here would have a better life than I did. Because there’s nothing shameful about being who you were created to be.

Nothing.

And, because love is always optimistic, I hope and I trust that just maybe, someday, sooner than later, we’ll all believe that.
