Bobbie’s story is inspirational on many levels, and for me represents the power of truth, exploration and acceptance. Her new book, TransMontana, is a must-read,  creating understanding and humanity through the components of sexual/gender/spiritual identity. All people must- if they are interested in integrity- explore the truth of their experience and strive to live it honestly and authentically. Bobbie’s life is a dramatic example of that process.

Alaska Lt. Governor Files To Change Driver’s Licenses To Include Gender Identity

Some good news out of Alaska:

Alaska Lt. Governor Mead Treadwell has filed a new regulation that governs changes to driver’s licenses and will allow transgender individuals to correct the gender marker on their licenses without undergoing major surgery. The regulation takes effect August 11. The American Civil Liberties Union and the ACLU of Alaska had challenged the surgery requirement as a violation of an individual’s right to privacy.

“We appreciate the work of the Department of Motor Vehicles and the Lt. Governor’s office in crafting a regulation that recognizes the important and legitimate needs of transgender Alaskans,” said Jeffrey Mittman, executive director of the ACLU of Alaska. “All Alaskans must be able to obtain a driver’s license that accurately reflects their gender and avoids disclosure of sensitive personal information unrelated to their ability to safely drive a motor vehicle. The government should never needlessly intrude into mandating specific medical procedures.”

The ACLU filed its challenge on behalf of a transgender woman, K.L., whose United States passport and work documents all identify her as female. After initially securing a change to the gender on her driver’s license, she was told that her new license would be revoked unless she submitted proof of having surgery.

“I am humbled and grateful for this decision,” said K.L. “It is my prayer that this victory will make a difference in the lives of transgender people.”

Many transgender persons are treated for a condition called gender dysphoria. Although the American Psychiatric Association agrees that surgery is medically necessary treatment for some, it is not required for everyone with the condition. Treatment for gender dysphoria varies from individual to individual, and many can be effectively treated without surgery.

Additionally, such surgery is beyond the means of many people and is potentially dangerous for some individuals. The State Department no longer requires transgender people to have surgery before it will correct the gender marker on passports, and a growing number of states have stopped requiring surgery for changing the gender marker on a driver’s license.

“The previous requirement had nothing to do with accepted medical standards and demonstrated a callous lack of understanding of what it means to be transgender,” said John Knight, staff attorney with the ACLU Lesbian Gay Bisexual and Transgender Project. “The government should not be in the business of dictating anyone’s medical care, especially when it comes to requiring surgery that may not be available, desired, or medically necessary.”

My Speech: Pride Rally 2012

From Yesterday’s Pride Rally: 

Last week someone said to me “Why do you people need a parade? Why do you have to make such a fuss?”

Here’s why:

We have been afraid to be who God created us to be. Sometimes it was our churches that made us afraid.

We have been legislated against- made criminals in the eyes of the law that is supposed to protect us.

We have been killed and we have killed ourselves.

We have lost good men and women to HIV/AIDS.

We have been bullied and teased and yes, driven from our very homes and schools and communities- and state.

We have been hurt and maligned right here under this big sky.

 

Why do we need a parade?

 

To remind us that there are people whose bravery has driven away darkness. Whose voices refuse to give in to hopelessness or complacency or fear.

That together, we can be that voice.

 

A voice to proclaim the goodness of our lives and the lives of our brothers, sisters, parents, children and friends- we are here and like it or not- we are not going away.

 

We will not forget the lives that have lived with pain to bring us here- to this place of hope and triumph.

 

Today is a gorgeous day in Montana History, because the Lesbian, Gay, Bisexual, Two-Spirit, Transgender, Intersex and Queer people of Montana- and our allies- are here to proclaim that we will not let our voice die.

 

We will not be afraid.

 

We will stand up when we are told to lie down.

We will speak when anyone tries to shame us into silence.

We will remain when we are told to leave.

We will proclaim the truth.

 

Firmly and gently and clearly and proudly.

The truth that we are light.

And that light makes Montana more beautiful, not less.  More.

 

I want to hear your voice.

Are We Good?

Are We Beautiful?

Are We Going Away?

 

We live in hope that one day all Americans agree.

Until then- we have a parade.

Because we.

Are not.

Going.

Away.

Transgender Breakthrough

I wasn’t sure if you heard word (Monday), but history was made once again.

For the first time ever, the Equal Employment Opportunity Commission (EEOC) has ruled that discrimination against an employee or applicant on the basis of the person’s gender identity violates the prohibition on sex discrimination contained in Title VII of the Civil Rights Act of 1964.

The EEOC’s decision means that transgender employees across the country who experience workplace discrimination can now file a claim with the EEOC at any of its offices across the country.

This is an incredible decision. We continue to make steady progress and are moving closer to the day when LGBTQ people and their families are fully recognized, protected, and supported.

EEOC ruling that gender-identity discrimination is covered by Title VII is a ”sea change” that opens the doors to employment protection for transgender Americans

An employer who discriminates against an employee or applicant on the basis of the person’s gender identity is violating the prohibition on sex discrimination contained in Title VII of the Civil Rights Act of 1964, according to an opinion issued on April 20 by the Equal Employment Opportunity Commission (EEOC). The opinion, experts say, could dramatically alter the legal landscape for transgender workers across the nation.

Report: LGBT Workplace Discrimination Common- High Impact On Performance And Health

Today, The Williams Institute released a report summarizing academic studies and other documented evidence of employment discrimination based on sexual orientation and gender identity, and the negative impact such discrimination has on lesbians, gay men, bisexuals and transgender (LGBT) people.  Although sexual orientation and gender identity have no relationship to workplace performance, during the past four decades a large body of research using a variety of methodologies has consistently documented high levels of discrimination against LGBT people at work. 

“This research shows that LGBT employees who have experienced employment discrimination, or fear discrimination, have higher levels of psychological distress and health-related problems, less job satisfaction and higher rates of absenteeism, and are more likely to contemplate quitting than LGBT employees who have not experienced or do not fear discrimination,” says Ilan Meyer, study co-author and Williams Institute Senior Scholar of Public Policy.

Results from the 2008 GSS provide recent evidence of discrimination from one of very few national probability surveys that have collected data about sexual orientation and workplace discrimination.  Among LGB respondents to the survey, 42% had experienced employment discrimination at some point in their lives, and 27% had experienced employment discrimination just during the five year period prior to the survey.

GSS data further show that employment discrimination is more common among LGB employees who are open about their sexual orientation in the workplace than among those who are not—38% of employees who are out in the workplace had experienced discrimination in the five year period prior to the survey, compared with 10% of those who are not out.

This new data shows that it’s still risky to come out about being LGBT in the workplace, “says study co-author Christy Mallory, Legal Fellow.  “Therefore, it’s not surprising that the GSS data also show that one-third of LGB employees are not open about their sexual orientation to anyone at work.”

These results are consistent with findings from other recent studies that reveal a continuing pattern of employment discrimination against LGBT people.  In several studies from 2010 and 2011 that report data on transgender people separately, the rates of discrimination are even higher.

“Recent studies show that pervasiveness of discrimination against transgender people in the hiring process,”   says Williams Institute Executive Director Brad Sears.   “The devastating results of this discrimination are confirmed by the high rates of poverty and unemployment documented in the transgender community.”

Recent research also reveals the negative impacts of discrimination against LGBT people.  Because of discrimination, and fear of discrimination, many LGBT employees hide their identities, are paid less and have fewer employment opportunities than non-LGBT employees.

Bottom line: “Research shows that LGBT employees who have experienced employment discrimination, or fear discrimination, have higher levels of psychological distress and health-related problems, less job satisfaction and higher rates of absenteeism, and are more likely to contemplate quitting than LGBT employees who have not experienced or do not fear discrimination,” says Ilan Meyer, Williams Senior Scholar of Public Policy.   “In contrast, supervisor, coworker, and organizational support for LGB employees was found to have a positive impact on employees in terms of job satisfaction, life satisfaction, and outness at work.”

Proposed DSM-5 Changes: Derogatory Labeling & Pathologizing The Identity Of Trans Persons

On May 5th, the American Psychiatric Association (APA) released a second round of proposed diagnostic criteria for the 5th Edition of The Diagnostic and Statistical Manual of Mental Disorders (DSM-5). These include two diagnostic categories that impact the trans communities, Gender Dysphoria (formerly Gender Identity Disorder, or GID) and Transvestic Disorder (Formerly Transvestic Fetishism). While GID has received a great deal of attention in the press and from GLBTQ advocates, the second Transvestic category is too often overlooked. This is unfortunate, because the Transvestic Disorder diagnosis is designed to punish social and sexual gender nonconformity and enforce binary stereotypes of assigned birth sex. It plays no role in enabling access to medical transition care, for those who need it, and is frequently cited when care is denied (Winters 2010). I urge all trans community members, friends, care providers and allies to call for the removal of this punitive and scientifically unfounded diagnosis from the DSM-5. The current period for public comment to the APA ends June 15.

Like its predecessor, Transvestic Fetishism, in the current DSM, Transvestic Disorder is authored by Dr. Ray Blanchard, of the Toronto Centre for Addiction and Mental Health (CAMH, formerly known as the Clarke Institute). Blanchard has drawn outrage from the transcommunity for his defamatory theory of autogynephilia, asserting that all transsexual women who are not exclusively attracted to males are motivated to transition by self-obsessed sexual fetishism (Winters 2008A). He is canonizing this harmful stereotype of transsexual women in the DSM-5 by adding an autogynephilia specifier to the Transvestic Fetishism diagnosis (APA 2011) . Worse yet, Blanchard has broadly expanded the diagnosis to implicate gender nonconforming people of all sexes and all sexual orientations, even inventing an autoandrophilia specifier to smear transsexual men. Most recently, he has added an “In Remission” specifier to preclude the possibility of exit from diagnosis. Like a roach motel, there may be no way out of the Transvestic Disorder diagnosis, once ensnared.

What You Can Do Now

  1. Go to the APA DSM-5 web site (APA 2011), click on “register now,” create a user account and enter your statement in the box. The deadline for this second period of public comment is June 15.
  2. Sign the Petition to Remove Transvestic Disorder from the DSM-5 (IFGE 2010), sponsored by the International Foundation for Gender Education.
  3. Demand that your local, national and international GLBTQ nonprofit organizations issue public statements calling for the removal of this defamatory Transvestic Disorder category from the DSM-5. Very few have so far.
  4. Spread the word to your network, friends and allies.
